Recently I got notice under 143(1)(a) asking for proposed addition of income. This notice tell's that the form used for comparison is Form 16. Here it is worth mentioning that I am not at all a salaried person and I am receiving all my income from my bank deposits. As such the question of Form 16 does not arise at all and not applicable in my case. Further, in my ITR filed I have clearly mentioned Rs.614750/- as Gross total Income (Income from other sources) which is being reflected as Income as per form 16 as per this notice. Similarly the amt. Rs.166220/- mentioned as Deduction under chapter Vl-A is being reflected as Proposed addition of income and Amt. Rs.448530/- mentioned as Total Taxable income is being reflected as Income as per Return. In this context this is my presumption that the system software being used by IT Dept.is either unable to differentiate between these major inputs entered in IT return for calculation of total Tax or unable to corelate these inputs to each others and giving unnecessary notices to thousands of honest taxpayers and harassing them. Further in my case when I open IT Dept. link to submit my reasoning and justification in this regards then the link first asks me to fill the column of TAN No. of the Employer and does not proceeds further as such I have been left with only one option not to submit my response with respect to this notice given by IT Dept. Any comments in this regards will be highly appreciated.
Try submitting response with TAN of bank (if same gets reflected in Form 26AS), and complaint about the unnecessary trouble with the facts under E-nivaran...... Good luck........
Yes, I have filled TDS2 in my ITR. For your information please Banks are not issuing Form 16. to their customers while crediting interest to customer and making tax deduction at source for this.
Banks are suppose to give Form 16A downloaded from Traces. You have to request for the same. The CAs of the bank branches are paid for this. if not Physical copy they can send you by mail.
