Interest and penalty -failure to pay service tax

Hi,

Person has collected service tax but has not deposited the same to the authorities for the year 2010-11 & 11-12. He has not filed the return too.What is the interest and penalty for the non compliance of payment and filing of return for the year 10-11 & 11-12. Person is an individual assessee with turnover less than 50lacs.

Is it mandatory to pay penalty while filing the return or it can be paid if asked by the govt.

Only 1 return can be filed for the 2 years or separate return is to be filed for each year and to be filed in ST-3 or any other form.

Can he claim service tax credit on the mobile phone expense and telephone expense incurred for the business for the year 10-11 and 11-12.

Penalty may no be paid however on demand pay immediately.

2 Separate return to be file for each year. For late filing of retutn also theer ispenalty which is required to be paid, refer link :https://www.simpletaxindia.net/2011/03/penalty-for-late-filing-of-service-tax.html

Cenvat of ST paid on cell fone exp is allowed.
