Income tax query related to medical bill

Hello Everyone,

My employer sought Medical Bill & LTA declaration in April-May 2016 where employess were supposed to enter amount they would like to claim under  Medical Bill (Rs 15000) & LTA. Any how I missed to give the declaration and now my employer is denying to give benefit of Medical Bill reimbusement & LTA amount because I  didn't make the declaration.

Now, I have two queries regarding this.

1. Is it legally valid that employer can seek such kind of declaration and deny the reimbusement if someone has missed it?

2. If employer is not giving benefit of Medical Reimbusement & LTA, How can I get benefit of it myself? Can I do something while filing my ITR.

Employer cannot deny the benefit of tax provision now just because it was not declared earlier. Declaration is taken in year beginning only to reduce TDS. One can always insist for this tax provision to be considered and reduce further deduction of tax. LTA benefit is to be given by employer only.

If still not considered by employer, one can claim income tax refund while filing ITR. Keep the medicals bill for documentation proof. 

Thanks for your reply. Please let me know on how can I claim refund while filinng ITR as in ITR -1 I don't see any head where I can declare this expense.
