Income tax on foreign salary

Tax queries 420 views 4 replies

Hello, I worked for an indian IT company from April 2014 till January 2015, and was changed my job to Singapore based company on work visa. I came to Singapore on 19-Jan-2015 and have been getting paid salary in Singapore, where as indian salary was completely stopped. The Tax will be calculated on my salary in Singapore for the entire year i.e. Jan2015 - Dec2015 and will be paid next year by April 2016. Here are My questions in order to file IT return in india for AY2015-16:

1. While computing my income tax liability for the period Apr 2014- Jan 2015, will the income earned in Singapore be added to the taxable income in India for the said period?

2. If the answer to above question is yes, can I claim HRA (for the rent paid by me in Singapore, please note there is no component in my salary slip called HRA)?

3. If the answer to first question is yes, then for how much HRA will be exempted (The actual paid or any other rule)? How about the taxes will be paid to singapore tax authotity next year, can i show the tax amount as paid in IT return?

Any help would be highly appreciated. Thanks.

It depends on your NRI status and if the SGD salary was paid in India or in Singapore itself and way you transfered to India and the type of account you transfered it to. There are many conditions that will decide this.

Thanks Uttam for replying. My status in Singapore is now Resident Singapore and for India is Non resident indian. But for the Financial year 2014-15 i stayed in india more than 180 days so it it resident india, not NRI. I got the salary credited to my Singapore bank account in SGD and then i transfered the money to my india Savings account  for "Personal Expenses".

There is an existing DTAA between the two countries I think so if you have not been taxed there you will have to pay taxes here. You should be able to claim HRA as per the existing appointment letter salary details and HRA rules.
