Hello,

One of my NRI relatives has received notice for non filing of IT return for AY 2015-16. The IT officers has noticed that there was a transactions in bank account for amount >10lacs in FY 2014-15. However he doesn't have any taxable income in India. This amount pertains to past years savings kept in different bank accounts and deposited in one bank account. What should be the ideal reply to notice?

Can we reply that there was no taxable income in any year and the amount in bank pertains to savings in past years and hence no return needs to be filed.

Kindly suggest

source of income whatever applicable

"This amount pertains to past years savings kept in different bank accounts and deposited in one bank account. What should be the ideal reply to notice?"

Your answer is clear, if you have bank statements of all the accounts, justifying the deposits. No income earned in India, by NRI in that particular year.

Only reply is sufficient like past year savings. No need to file return as ur client doesnt have any income in india. U can also write this.

reply to the officer with full details and annexed all bank statements

If it is NRO account TDs would have been deducted from the bank account for claiming the TDs deducted it is advisable that you file the income tax

IF RECEIPT SIDE OF PASS BOOK MORE THAN 1000000/-  BETTER TO

FILE RETURN SO IN FEATURE NO ONE CAN TAKE OBJECTION ON

INCOME WHICH (INTERANL TRANSFER WHATEVER )

File the return and annexures are to be enclosed along with bank statements to the Income tax officer
