Yes , infact I am pretty  sure that authorities upto the level you said will not be able to grant him relief in this issue ..it will be ony after first appeal (CIT(A)) or second appeal(ITAT) that he may get relief...or even he may have to fight to other level of appeals (High Court/ Supreme Court) ...
