ask ur AO to issue notice u/s 144 . and file ROI in respond to this.. simple..

How to request A.O to issue notice under section 144?

contact AO for discussion..
MUST BE TRY AND ALSO TELL US ABOUT RESULT

I have practically tried and was successful. Matter of nexus and negotiation

I differ the previous answers ..AO cannt at his own can issue BoJ notice u/s 144.  JC must be approved and hence negotiation with AO does not serve purpose.. Also even if RoI is filed in responce to notice u/s 144, 143[2] scrutiny proceedings can be invoked.   Hence better forgo the Refund if the intention is to claim refund..

bt if refund is genuine and have much more amount than it is more beneficial to assessee.

Hi,

Best way is to approach the AO to call for notice U/s 142(1). File the return in response to the notice claiming refund.

But this will be an initiation for scrutiny assessment u/s 143(3). If the records are clean and the amount is huge, can go for it.

Sorry ..No assessee / Representative can ask any AO , to send notices sec: 142[1] , sec 144, 148 etc.. It is based on machanism adoped by the dept.

CBDT can condone the delay and hence it is answered  accordinly,, [apprach Board throu your PCIT's office narating the reason for delay] and you may win over.

It could be done on a word of mouth arrangement though.
