How to avoid PF Applicability by Pvt Ltd Company

Hi Senior Professional & Colleagues,

Can you all clarify Yes or No along with reason on Employee Provident Fund and below are my list of queries.

1)       Even on indirectly employees (Contractor), Company has to deduct PF & Contribute PF, In case contractor doesn’t have PF No or not Deducting PF, is it Company responsible?

 

2)       If a Contractor employ less than 20 employees in his company and 1 among them is working with our company on a contractual basis, then our company has to Deduct of PF /Contribute it’s sharing??

 

3)       For eg : companies in Media Industry where they produce film and hiring employees on contractual for daily basis , Even these employees suppose to Applicable PF , if then how it is possible to maintain record?

 

4)       Last but least “What is the remedy to avoid PF applicability and what are the other way how we can recruit employees in company.

 

Waiting for your all, comment on the above question.

 

Please let me know any seminar is conducting on PF in future.

Dear Friend

agst. your query no. 1.  your company is still liable.

agst. 2nd query  I am unable to understand what u want to ask. sorry, refer to bare act.

agst. query no. 4 , again read the pf's bare act it says All employees in such factory or establishment including contract labour, but excluding casual labour

so enter your labour as casual labour for the persons you don't want to deducted the pf.  u can enter casual labour up to 239 days
