Dear Sir,

Please refer to below scenario and help us with the solution.

  • GST number is SUSPENDED because of NON FILING of returns.
  • Taxpayer filled all the pending returns with 30 Days.
  • Taxpayer FILED the application (on dated 1st December 2021) for regularization the GST Number under Registration - "Application for Filing Clarification" but it's pending for approval by the Department till 30th December 2021.

CAN TAXPAYER RAISE THE TAX INVOICES FROM THE DATE OF SUBMISSION OF APPLICATION FOR REGULARIZATION ?

Please suggest.

Hey Leela! Here’s the situation regarding issuing GST invoices when your GST registration is suspended but you have applied for regularization:

Key points:

  1. GST Registration Suspended = Temporarily Deactivated
When GST registration is suspended due to non-filing of returns, the taxpayer is not allowed to conduct business under that GSTIN, including issuing tax invoices, during the suspension period.

  2. Application for Regularization Submitted
Filing the application for regularization (e.g., filing pending returns and applying for revocation) is a good step but does not automatically reinstate the GST registration from the date of application. The registration is only considered active once the department approves the revocation.

  3. Issuing Tax Invoice during Suspension Period
Since the GST registration is still suspended and approval is pending, you cannot legally issue GST invoices from the date of application till approval is granted.

  4. What if you issue invoice during suspension?
Any invoice issued during suspension will not be considered valid for GST credit to the recipient, and the taxpayer may be liable for penalties.

So, answer to your question:

  • No, the taxpayer cannot issue GST tax invoices from the date of submission of the application for regularization while the GST number remains suspended.

  • You should wait for the department to approve the regularization (revocation of suspension) before issuing valid GST invoices.

What you can do meanwhile:

  • Keep proper records of supply transactions.

  • Inform your customers about the temporary suspension and that invoices will be issued once GST registration is regularized.
