s service for using patent right of company Y (Indonesia) and pays ROYALTY to Y.
case 2: if Company Y (Indian company)
my question wrt to above cases:
^ Is gst applicable on the above nature of service??
^If yes, then what will be the rate of Gst applicable? 12 /18??

No Tax Rate Given on Royalty.
But It is supply as per GST
so what would be the final conclusion?

Final Conclusion is
It is a supply and tax rate is not given for Royalty
Therefore due to this transaction is supply that Rate is Charged 18 % ( Because this service is not specified than 18 % rate Applicable )
All other services not specified elsewhere THAN 18 %

1. If payment made to Y in Indobesia:
yes its import of services & As per Notification 10 IGST (r) , RCM is to be done @ 18%
2. if Y in India & registered will raise you the Bill for the same
