Dear sir,
we are paying maximum Rs 2000.00per month as maintenance charge to our builder. But he is adamant and force us to pay 18%GST.
(we understand from GST rules on Services as per page 9 clause 26 upto Rs 5000.00 per month No GST applicable for residential apartments maintenance)
Before GST he charged unilaterally 14.5% service tax which we are going on opposing. Till now he didn't show the evidence of tax remittance which collected from us.
Sir, will you give right suggestion and guidance, we will be more thankful to you for your earliest reply.
I have attached the builder message for your information.
Regards.

"""Dear All,
We are in receipt of your mail. Please note that as a builder if we collect and maintain the building we are liable to pay GST as we are rendering a service to you.If association collets and maintains then there is no GSTThis point has been clarified by us several times in the past and we do not understand why you keep raising the issue repeatedly. We have also suggested several times that in case you donot want to pay GST,the association can take over the maintenance and maintain the building
If you still have any clarification on the applicability of GST you can address your query to the GST department of Government of india and get a clarification letter in writing about the applicability of GST.
If you donot pay the maintenance immediately with GST, it is not possible for us to maintain as we do not have funds in maintenance account which is already having a deficit.
Hence you are requested to take over the maintenance from us in case you donot want to pay GST.
Other points we are considering the repair of CCTV and Lights etc here again the fund is a problem.
With Best Regards,
