Gratuity

Hello Guys,

I have a question on Gratuity. I had worked for an MNC company which is located in mumbai for about 4 years 7 months. As per the rule the gratuity would be given only after completion of 5 years. But I have read one forum where in chennai the court has advised the company to pay the gratuity for the employee who has left the company after 4 years and 10 months.

So is it the same rule applicable for the people of mumbai to get the gratuity?

Are the gratuity rule is same for all over india or it is different? 

I have checked with my previous company HR  and they said it is 5 years in our company. Please help guys.
