If a person resigns after serving for 8 yrs in Govt. Organisation, is he eligible for gratuity payment?  even though he is not eligible for retirement benefits?

Eligibility for Gratuity - An employee who has completed 5 years of service is eligible for receivng gratuity [ Supreme court judgement says 4 years + 240 worked days = Eligible to get Gratuiry]

Gratuity is payable on the occurence of the following

Death, Disability, Resignation, Superannuation

Thanks for your reply, but It's in the case of Payment of Gratuity Act applicable for Pvt/Public sector employee.  Is there any policy/guidelines being issued in respect of Govt employees?
