Gift to or from parents is taxable?

Dear Professionals,

I have few questions on Gifts within Relatives.

1. If a major/independent son proposes to gift Rs1,00,000/- to his mother. Is this gift taxable (if yes, to whom)?

2. Is there any cap on such gift amount and under which section this is covered?

3. What are the tax benifits for a gift to spouse or fiance?

Please help me in clarifying the above (if possible in detail with examples)

Thanks in Advance

Rama

Replies (1)

1. Gift from relatives are exempted from taxable income u/s 56(2).

2.N/A

3. There are no tax benefits for giving gifts to anyone. In case of Fiance, even gift above 50,000 in a financial year will be taxable in her hand as it doesn't cover in the definition of relative.
