Form No.8 - Filing of Charges with RoC

Hi,

We had to file Form No.8 for filing charges with RoC. The attachment was running in to about 100 pages.

In order to maintain the file size requirements, we have attached the first pages of attachments with Form No.8.

The form is uploaded and payment is made by credit card.

When we tried to fill-up Form No. 67 as an adendum to file the rest of the attachments, Form No. 67 is not recognising the SRN generated while filing Form No. 8.

Now we are left with no choice to file the remaining attachment.

Is there any way left now? What should be the normal practice when we have to file a lot of pages as attachments (beyond one go size)

Hi Rajesh,

You need to burn a C.D. with the following documents:

1. Final Signed Form 8

2. 100 Page attachment

3. Scanned copy of paid challan

submit the C.D. in ROC along with certified physical copy of your 100 page attachment.

Dear Mr. Rajesh

I suggest you that you can wait of the ROC response, then u can take the next step of submission of balance paper of attachments. Form 67 is generally for rectification of defect or incompleteness not for additional filling.

In other side of filing Form-8 there is no mandatory requirement for attachment of any instrument creating or modification of charges.

Hello Rajesh,

Form-67(adendum) can be filled only when we are asked to do so by ROC.

I think you should first check the transaction status with the respective SRN at MCA portal.

yes, Right, You should check the status of form-8 and when it shows user clarification, u can file Form-67 entering SRN of Form-8 and upload it. It wil be convenient to you.

and one more thing, in Form-67, still if you are facing problem of Big sized adobe Doc. check out the following link, from that you can reduce the size of doc.easily and attach it with the said form.

As you 'll said, we have noticed the status of filing for 'User clarification'.

We had to take extra causion to keep the size of Form No. 67 within limits, since multiple forms are not allowed.

The same is being filed. Hope it will be through this time.

Sir,

If we are filing form 8 for modification, and there is addition of security for the enhanced limit provided by the company as well as by some other company as collateral security, do we need to mention the collateral security provided by the other company under the 15the and 16th point of form 8?

Not necessary, the charge will be only on the properties of Company. If your are filing form 8 for those companies as well for corporate grarantee as well, in that case you may mention those properties.
