Form 16 gross salary is wrong

I could not file my taxes for the assesment year 2013-14 as my previous employer did not give me the form 16 by June 31st. And I did not have all the payslips.

Last month, Feb 2014 I received the form 16 and it contain wrong entries with Gross salary being shown higher by around 1.1 lakh. I requested my previous employer to correct the form 16 and send the revise form 16, but they are not doing it.

Mostly they will not send me a revised form 16.

If I file my taxes according to the form 16 given by them I would have to pay 20,000 as tax. Form 26 AS and form 16 are also not in line - do not tally.

Can I file a complaint with the IT department and  file my returns with the help of a CA. I did check with the CA and he said - he can file based on form 16 and he cannot help me much in this case.

Please note that as per CBDT circular no. 4/2013 dated 17-04-2013, it is mandatory for the employer to issue TDS certificate i.e. Form 16 to the employee by downloading the same from TRACES Portal latest by the date of 31st May of the following relevant Financial Year.

If the employer does not issue the TDS Certificate in the prescribed time, then  there is a penalty of Rs 100 per day.
