Filing of Charges with ROC

What is the procedure for filing charges with the ROC? Also please indicate the time limit for filing from the date of creation of such. And what is the format for maintaining charges register?

Please explain in detail.

Down load the Form from MCA.gov.in, Fill it up & add digital Signature and File  the form in same website

For any form of ROC time limit is 30 days from the date of creation or what ever

Form 8 has to be filed within 30 days of creation of such charge. The form is avaliable with the mca.gov.in website

If the Charge were created  before 06-07-08 than  u can file charge within 300 days if not than in 30 days of the event. U will find the form 8 on www.mca.gov.in
     

Is there any minimum amount of funding which requires any ROC charge creation under any statute?

Dear Sir,

What is the procedure for ROC Filing and what are the requirements and what are the charges are taking.

Whenever a company create a charge on its assets, with in 30 days it has to file Form 8 with ROC ( Form 10 in case of series of Debentures).

Procedure:

1. Get the details of charge -if the charge is created in favour of a bank, get the sanction ticket, copies of the documents creating or evidencing charge,copy of the Board resolution given by the Company.

2. Download Form 8  from MCA website and fill up.

3. Scan the documents creating or evidencing charge ( black & white, Resolution 200dpi, pdf file) and attach it with Form 8.

4. Toal file size should not exceed 2.5 MB, if exceeds, remove the scanned attachments. Attachments can be uploaded separately as Addendum.

5. Get the Digital Signature from Company & Bank.

6. File the signed form 8 by  E-Filing through MCA website.No paper filing is possible.

7.The fee will be Max.Rs.500/300/200 depending on the Authorised capital of the Company.to be paid either through credit cards or Bank Challans

8.See that FOrm 8 is filed with in 30 days( 60 days with additional fee) after the date of the Document creating charge.

9.If you are a first timer in E-filing, better get the help of a  practising Company Secretary or Chartered Accountant. They charge you around Rs.1500/-

Hello ,i wanna knoe that when i filed form 8,the status message shows held in abeyance,wht does tht mean. Actually i filed 3 forms ,in which 2 of them are pending for action and one is showing held in abeyance .I had to do addendum for the one which is showing pending for action.

As u are saying that u file 3 Form 8 with Roc and 2 of them are pending for action and one held in abeyance.

Pending for action means either your challan payment are not confirmed from bank/MCA or after payment it is not assigned to ROC officer for taking action and in that case u r not required to file further form 8,you can just wate for their further action.

 

Held in abeyance means, your form filed with Roc required some scrutiny from ROC official end, i sugges u that in this situation u personally visit concerd ROC and resolve the matter.

thanks a lot .....But if its not possible to visit the concerned roc wht shud n done ??/ actually roc is in patna and i live in ranchi ...plzz suggest .

can i now that what is the mean of charge with roc.
