Filed as Resident instead of RNOR

 Hello,

 

I lived in USA for 10 years and returned to India in Sep 2007. I have RNOR period for 2 years 6 months. I just now noticed that my taxes (2008, 2009) were filed with Resident status instead RNOR.  Do I need to correct this? What is the way to correct this?

Dear Sunder

 

Residential status determines the scope of income chargeable to tax.If your taxable income remains the same then no need to revise the return. 

Please refer sec 139 - defective return.

u should file the revised return.
