Exemption benefits u/s 10 for salaried individuals

Tax queries 1997 views 8 replies

Hi,

I have a client who recieved Form 16 from his employer. In Form 16, the employer only gave exemption benefit of Transport allowance of Rs. 800pm and no other exemption benefits like Medical allowance (Max 15k), Education allowance (Rs.100pm/child) etc have been given.

My question is, while filing IT Return, can I take benefit of Education & Medical allowance exemption even tough the same is not stated in Form 16?

Thanks in advance.

You can take the benefits of exemptions/deductions not provided in Form16.

Yes you can take it.

No you can not take benefit of medical allowance unless and untill it is mentioned in your CTC....you can avail the tution fees as a deduction while filling your return........

Yes you can claim all exemption/ deduction not provided in form 16 at the time of filling of income tax return
To claim these exemptions make sure that these are provided to your client as a part of salary, i.e, it is shown separately in his/her salary slip. If so, you can very well claim it.

None of the exemptions are mentioned in salary slip nor in CTC. But still, the employer has stated conveyance allowance in Form 16 as exempt from salary.

what is salary breakup? yes
