Excise on Power sold (Captive Consumption)

Dear

Company A is Producing Taxable Product under Excise and utilizing the Power Generated by them (Captive Consumption)...

Company availing Credit on the Inputs used for Production of Power, as the final product of Company A is Dutiable...

But Company A sale the Excess power to Outsider also the Residential Colony outside the Factory..

So there is liability of 10% of Realisation..

Que is that whether any Deduction allowed from the Realisation such as Electricity Duty..

If Yes what the Condition..

Proportionate duty should be reversed or 5% amount should be paid.

Does 5% Rate applicable for 2008-09.

Another Que whether Electricity Duty paid agst Sale allowed as Deduction for The Base Value for 5%

 

 

Rate was 10% at that time.

This amount is to be paid @ 10% on electricity value, without including electricity duty.
