Entitlement of bonus (urgent)

Hi,

Pls help me out, I am working with a Pvt company, and at the time of joining my CTC was fixed 5.00 lacs P.a. They have started given me on monthly basis 36000/- (i.e. 500000/- divided by 14 month) and told you will get two month salary as Bonus and Leave encasement. Now they don’t need me and can’t pay such a higher amount. I have served total 9 month from dec’2010 to Sep’2011. Now they have to give puja bonus but they refuse to pay me. After some time they agree to pay me proportionate bonus only for the P.Y.2010-2011 (Dec to March).

So pls tell me is there any legal provision so that I can get my share of bonus from April’2011 to Sep’2011.

Hi Ravi,

As per the provisions of Bonus Act, An employee whose Basic pay is less than 10000 is entitled to a statutory bonus of 8.33% if such person is working with the company for more than 6 months for a financial year.

To work out your case, I need your breakdown of components like basic, HRA, Other allowances.  Otherwise if your basic is more than 10000/- pm you cannot claim the bonus.
