Eligibility for gratuity

You will be eligible for gratuity as you have rendered services of five years. Giving notice is just an intimation not the termination of services.

You are eligible for gratuity even if 5 years is not complete, if service period is more than 4 yrs 6 months it would be counted as completed yr of service

Agreed. Rounding off is allowed. An employye is eligble for Gratuty if the enterprise is covered under the P.O.G.A, 1972, provided he has been in an uniteruppted continous service for not less than 5 years.

However, continous service of 5 years is not necessary where the termination is due to death or disablement..............

In my opinion, rounding off is applicable for calculation of gratuity not for deternination of eligibility. For calculation of eligibility of gratuity, there should be contineous services of five years.
