Efiling of itr iv by legal heir

I have to file on my deceased client's ITR IV for the A Y 2010-11 through Legal Heir's digital signature. My clients case audited u/s 44AD. I have sent necessary information to AYAKAR DEPT's website on 29/09/2011 & 30/09/2011. Still I have not received any revert from them. The due date for filing audited case was 30/09/2011. What steps I have to take.

If you have a proof of ur communication to Aykar Vibhaag then just file ur return as normal (through Legal Heir's digital signature).

 

If it shows some error then just send me the snap shot of error message. Otherwise it will be excepted. And don't worry about communication because as Its Goverment Work.

 

If you receive any type communication in future for this matter then u can present the copy of ur communication to them, And since you had alredy communicated to department so you are discharged from your liability.

Being a Professional how can u afford such a mistake by not filing Audit Report on or before due date.

In ur case u should have filed Audit Report with jurisdictional Assessing Officer alongwith one covering letter stating the facts of ur client's case on or before 30th Sep (i.e. due date for tax audit) to avoid penalty.

This reply is to avoid such an eventuality by others.

I have approached the concerned authority on phone in this regard and the authority was not in position to accept the hard copy of Audit report on 30/09/2011. As the e filing of audit cases are mandatory how can i file the hard copy of audit report and there was no particular reply from Ayakar Website authority. Unless Aykar reply for my mail I could not e file the return. If there is any options please guide me. 

If there is any technical snug in efiling of tax-audit returns like in ur case, first & foremost step is to file Tax-Audit Report with Jurisdictional Assessing Officer (Ward ITO) alongwith covering letter stating facts of such technical problems. This has to be done to safegaurd the assessee from levy of penalty.
