E-stamp duty payment after filing inc-2

I had filed INC-2 (after filing DIR 3 and INC 1) on February 7, 2016 for registration of a One Person Company. On filing, C series SRN was generated and the total fee paid on form was Rs. 2600 (break up - Fee for INC-2 Rs. 300, MoA - Rs. 2000, AoA - Rs. 300). The type of fee mentioned in the challan is "normal fee" for all the payments. I had chosen the option that the e-stamp duty be paid online on MCA, but no D series SRN was generated on filing.

Once the payment was made, I checked on the status and I now see "Awaiting stamp duty payment". I select "Pay stamp duty fees" on the home page, and enter the C series SRN, it says SRN has expired. If I try to fill up Form 1, there are some prefill options which are not allowing me to fill any details.

I have come to a deadlock situation. Raised a ticket, but no response. How should I proceed? The form is pending for almost a month now. Is the stamp duty paid with INC 2? Or do I need to pay it through some other way? Please help.

Dear Atidi,

Stamp duty can be paid with INC 2, if you could not pay while filing for INC 2, log on to MCA Website, under PAY FEE selection PAY STAMP DUTY FEE, insert SRN of Form INC-2, select original stamp duty auto button and submit, than you can make payment by using net banking or credit/debit card.

But problem here is time for payment of stamp duty challan is expired, i request you, not to make the payment, go to ROC office, speak with concern offical, take appropriate steps,

Thank you. Just wanted to know, the normal fee paid isn't the stamp duty fee? Will check with the ROC office as suggested.

Aditi,

In normal course, when you file INC-2 along with other forms if any, Two challans would be generated,one for ROC and other for stamp duty.Hence ROC fee challan does not include Stamp duty, you got make the payment separately.

Ok. Thank you so much for your patience. Yes, I had only one challan generated unfortunately. No indication was given to pay stamp duty fee as well. Like you suggested, will get in touch with the ROC office and get things moving.

ROC will start the processing of inc-2 only upon receipt of the processing fees and Stampduty. . You will have to refile inc-2 as the status of the original SRN is expired and pay stamp duty . You can claim refund for the fee already paid and the details for refund are available in MCA 21 Portal. It may also be noted that challan for processing fees and stampduty will not be generated simultaneously at the time of e filing and the link to pay the stanmp duty will be activated after one or two hours after paying the ROC fees against SRN
