Our client is penalized and issued order under section 74 (9), now we want to file a appeal, so now we have to deposit 10%tax of disputed amount. the query is we should create a DRC. -03 against this disputed challan amount.

Is Form GST DRC-03 Mandatory?

No, Form GST DRC-03 is not the automatic or standard method for paying the mandatory pre-deposit for filing an appeal.

While many taxpayers use DRC-03 for voluntary payments during the investigation stage, the GST portal does not automatically link these payments to the specific Demand ID created by your order (e.g., Form GST DRC-07). Consequently, when you attempt to file an appeal, the system may fail to recognize your earlier payment, leading it to demand the pre-deposit again.

The Solution: Form GST DRC-03A

If you have already made a payment via DRC-03 that you intend to use toward your pre-deposit requirement, you must perform the following steps to avoid paying twice:

  1. File Form GST DRC-03A: This form is specifically designed to link your previously filed DRC-03 payment to the relevant Demand ID.

  2. Verify the Liability Register: Once you file DRC-03A, the payment will be mapped to the demand order and reflect in your Electronic Liability Register (Part II).

  3. File Your Appeal: After the system recognizes the mapped payment, you will be able to file your appeal (using Form GST APL-01) without being prompted to make additional payments, provided your total linked payment meets the mandatory 10% threshold of the disputed tax amount (as required under Section 107 of the CGST Act).

Summary of Requirements (Section 107)

Under Section 107(6) of the CGST Act, before filing an appeal with the First Appellate Authority, you must pay:

  • 100% of the tax, interest, fine, fee, and penalty that you have admitted to; and

  • 10% of the remaining disputed tax amount (subject to a maximum of ₹25 Crore).

Recommendation: Before initiating the appeal, check your Electronic Liability Register on the GST portal to see if your previous payment is already accounted for against the demand.
