Donation

Tax queries 1232 views 6 replies

Dear All,

My company has given Rs5000 for gifts and sweets to students of Govt. Inter College who participated in games arranged by the company.

They have booked the expenditure in Donation A/C, whether it is qualified for 80G deduction?

In my view no!

However the school has given the certificate.

Kindly reply asap.

Thanks

Deduction in respect of donations is available if any sums paid by the assessee, being a company, in the previous year as donations to the Indian Olympic Association or to any other association or institution [established in India, as the Central Government may, having regard to the prescribed guidelines, by notification in the Official Gazette, specify in this behalf] for (i) the development of infrastructure for sports and games; or (ii) the sponsorship of sports and games,in india. IS CLEAR?
If Receipt is for donation & College is run by charitable/society regd.in 12 A .Exemption is available u/s 80G.
if the college charitable / society regd.in 12 A then Exemption is available u/s 80G.
The company cannot claim the expenditure under section 80G
madam, what you are saying?? why a company can't claim 80G ??
For payment of Rs. 5000/- you can claim 80G only if school is registered u/s. 12, for Sweets you can not claim deduction
