we are registered in telangana and we purchase goods from maharastra the seller charge us CGST AND SGST as we are taking delivery of goods in maharastra and place of supply is maharastra only and we are carrying goods in our vehicle from maharastra to telangana
so my question is can we claim ITC in GST

you can ask supplier to raise inter state sales invoice with your GSTN
Supplier correctly charged SGST & CGST as you bring goods with yourself.

Also you can claim ITC for same.
As Mr. Parv said correct, if you have registered in MH than you can take credit for the same in MH
Supplier is correct way As per place of supply.....
Also you can't claim SGST and You can claim CGST only....

You ll ask your supplier for Raise Inter State supply bill....

Mr. Vipin can you clear that you have registered in MH or not ?
if not than than if you want to credit for the same than ask supplier to raise invoice bill to TALK and ship to MH than you will get IGST full credit.

but if you are not registered in MH than you will not get any credit.

although if you asked him that the goods will actually consume in telgana .
as you didn't say anything by default he charge the state tax
Material will consume in Telangana and supplier has to issue IGST invoice as both have GSTIN, but only thing is that the supplier not carrying goods to Telangana that Is the reason he treated as intra state sales.

As per IGST Act Section 10(1) The Place of supply of goods where the supply involves movement of goods, wether by the supplier or the recipient or by any other person, the place of supply of such goods shall be the location of the goods at the time at which the movement of goods terminates for delivery to the recipient, and in your case it's Telangana where it terminates so you have to ask for invoice with IGST, hope this will clear you doubt !
