Hi,

I pay 15000 as rent per month. My landlord initially agreed to provide PAN no and now did a complete U-turn and refusing to sign declaration or provide PAN. I transfer rent to his bank account every month and so it all the more doesn’t make sense as to why he is not providing his PAN no. I have however figured out his PAN number from a neighbour to whom he had sold the flat. So my question is

1. Will he get to know if I submit his PAN number without him knowing about it? Will it have any implication on me?

2. Or should I make the declaration of no PAN with his signature missing, and attach my bank account statement of transfer of rent every month to his account along with rent agreement?

I want to get the legitimate tax relief under HRA that I am entitled too at the same time don’t want the owner to ask me to vacate

This problem faced by so many persons. u can give declaration to company am staying 6 (rent=90000) months in one house and 6 (rent-90000) months in another house so the amount is less then 100000 am not obtain pan number.

making payment online or by cheque is not the proper compliance of PAN data requisition, ask your land lord once again to provide the same  as the amount is under ambit of PAN verification 

He (the landlord) knows everything but he is still being unreasonable and not willing to provide the PAN no.

Will there be any implication if I provide his PAN no without his knowledge for HRA purpose? Will he get to know about it? Or should I submit the unsigned declaration form of NO PAN stating his bank account details to which I transfer rent along with my bank statement as a proof of transfer of rent every month?

I am not sure as to which is the right option, enter his PAN or provide No declaration form. 

Lot of people who know their Landlord's DOB has easy access to PAN no and submit their PAN no. So just wanted to know is that a wrong thing, will the landlord come to know about it.

This serves no purpose as in that case I will need either two parties rent agreement or receipts and per month still is 15000 and not 8333 and overall 180000 for the year, so that will not be a solution to it.

PAN is submited to company only if the paymnet exceed 100000. you can say am staying 2 houses the rent is below 100000 there fore pan is not required. TDS apply for exceeds 180000.

Do not worry. Keep 12 months pay slips of bank deposits towards rent. Also keep the copy of rent agreement. If you have rent receipts then also keep them carefully. If your emloyer refused to give hra exemption in the absence of pan of land lord then dedeuct them tds and claim the same at the time of filing of return in form of refund. No body can stop you claiming the same. If can not wait till the return date file an application at local tds ward of income tax to handle this situation.

It is mandatory to provide PAN number....but the solution of the problem is you should show your rent in two parts either as a rent of 2flats or break the rent as in two amount..

PAN number is only mandatory whenever the amount (payment) exceed 100000 

keep all rent receipt...
