In one of my Company , An individual Auditor has expired as on 15/03/2015. Now the Company wants to appoint a new auditor in place of him .In this case who should we go ahead?
Company has not yet Filled ADT-1 for the FY 2015-16 for the period 2016-17 and nor Filled AOC 4 & MGT 7 yet (financial Statements)
We want to now remove him & appoint new auditor in his place . In this case what has to be done? Which forms are required to file & procedure to be followwed

It is the case of casual vacancy under section 139(8) of the companies act 2013. Here, Board of directors have to appoint the Auditor within 30 days of such vacancy. As per your query it seems you have not appointed auditor yet which results in the contravention of the said section and is liable for punishment for contravention under sec 147 of the Act. So, it is suggested to consult with any Chartered Accountant or Company secretary for the further steps as per your convenience.
