Custom duty on import of used i phone

my uncle who is at jeddah sent me an i phone 5s via courier(DHL COY.) on 28 dec.but the custom deptt. at delhi airport is not giving clearence by saying that thereis a penalty on the import of used goods.i dont know what to do as the shipping coy viz.DHL is saying me to make the custom clearence my self.DHL also sent me some documents which ill forward to you.i dont know what is the issue,they r treating me like a commercial importer but the phone is sent to me as a gift from my uncle.i also want to know that how much of penality i may pay for it.

U may only pay custom duty on ths value.

Or u can ask frmbyr uncle authority letter that this phn is send as gift.

LOOK, WHEN YOU IMPORT ANY ITEM INTO INDIA YOU NEED TO PAY CUSTOM DUTY

WHETHER ITS VIA DHL INDIAN POST FEDEX WHATEVER,

YOUR QUERRY ABOUT CUSTOM DUTY, YOU SAID THAT ITS A GIFT ACTUALLY ID DOESNOT MATTER WHETHER ITS A GIFT OR YOU PURCHASED ONLINE, YOU HAVE TO PAY CUSTOM DUTY

YOU NEXT QUERRY WAS RATE OF CUSTOM DUTY

FIRST OF ALL CHA (custom house agents) will assess the value of your phone then they will convert it into indian currency (for currency conversion rate kindly download notification on nov 2013 revised rates foriegn exchage), then you will be charged a custom duty of 28% + 12.36 ST + dhl flat charge.
