Creation of charge with roc

MCA 1625 views 4 replies

Hi i am practising CA. A bank has asked me to create a charge with ROC for one of its Clients who has availed a loan from them.

I understand that the requisite form 8 has to be downloaded and filed up and then uploaded on the site.

My question is can this be done under my digital signature or will it first be signed by the directors/ authorised representative and then my digital signature will only be like a certificate.

Just need a clarification so that i can explain to the bank accordingly. Thanks

Hi neeladri

On form 8 the company's directors/authorised signatory's sign, chargeholders signature and certifying professional's signatures are affixed. Thus u will b requiring co's signatures as well as urs for the same.

yes anusha is right. DSC's of company director, bank representative, and certifying professional will be required.

Agree with sangram

On duly filled form 8, first the sign of Director will be afixed, then it will be signed by the Bank and thereafter the certification of professional would be required.
