A company can go for winding up under EES, 2011 which is in force from January  but the said company has to be incorporated before the year 2002.

Definition of Defunct Company is Company registered under the companies act which is not carrying over any business activity or operation on or after 1st April 2008 and includes a company which has not raised its paid up capital as provided in Section 3(3) and (4) of companies Act.
