Commission income but no tds deducted

Hi, I am an affiliate marketer and I earn commission every time I make a sale of otehr's software.

All things happen online.

I advertise other's software on my website and get a commission when my website visitors make a purchase. All the software owners are outside India.

I recieve all the earnings through PayPal or Payoneer to my bank account.

No TDS is deducted from my commissions by the software owners. Can I file the returns under 44AD with 8% income through my income is more than that?

44AD is not available for commission business

 

Even if no TDS is deducted from my income?

Only the nature of income is important while taking IT computation. TDS deducted or not is a second question and the assessee is not responsible for TDS default. the payer is responsible for TDS

Here the nature of income is commission so you cannot opt 44AD as per proper channel..

I asked the same question at incometax website through their live chat and they say if tds is not detected then can file under itr4.
