Dear All,

 

There are two different activities of an assessee which are not related to one another i.e., Taxable service, Manufacturing Goods.

Can Credit availed on input service related to output service be which is under one registration number of the assessee be set off against output excise duty liability with different registration number of the same assessee.

Dear Pooja,

As far as the cenvat credit rules are concerned there is a requirement that to avail credit on input/input services it should be related to output/output service. As per Rule 3 But there is no such specific requirement in case of utilization/set off.

Can you brief about the basis of your answer.

 

If there is one entity and the precints are same for manufacturing and service activity, the eligible cenvat credit for manufacture canbe used for services and vice versa.

In the above case,  if the precints are different i.e., there are different registrations for each taxable service (old Regime) of the same entity.

Whether the input service credit related to one taxable service can be setoff or utilised against another taxable service or duty liability of excise.
