Quick Summary
This discussion explores the eligibility of Input Tax Credit (ITC) for hoarding rent expenses when the supplier is from a different state. While advertising expenses are generally eligible for ITC, the key factor is how the supplier has charged the tax. If IGST is charged on an interstate supply, ITC can typically be claimed. However, if the supplier incorrectly charges CGST and SGST, the recipient in another state cannot use this as ITC to offset their liabilities.
You can claim in case supplier charged IGST as CGST and SGST credit in case of Inter state supply not available. For Eg hording situated in Noida Uttar Pradesh, Receiver registered in Delhi, supplier charged CGST and UPGST in bill in this case receiver in Delhi cannot use CGST nad UPGST as ITC for set off their outward liability.
