Ca firm not paying last month salary

Hey guys,

I had completed my articleship last year in April 2016. As per ICAI rules i completed my required hours, and I worked one more month EXTRA (which was not required by ICAI ) to complete all my audits and do handover in May 2016.

I had been paid all stipends upto april 2016 but one more month of salary (May 2016) is still pending.

Everytime i call the partner and ask for it he gives excuses or doesnt pick up the call. This went on for 1 year and i started SMS'ing him so that i have proof of trying to collect. But he gives stupid excuses. And now I'm fed up and just want to be paid.

I do have proof of working in May 2016

What is my legal recourse? How do I go about collecting it? Should I contact the department of labour? should i file a lawsuit? how do i proceed with that?

Make a written complaint to the ICAI.

No No....
The payment can't give the firm owner. It's very bad habit.
But,
You can't take any legal steps or can't be complaint to ICAI. Bcoz, You are worked after complete the time. Then it's taken any misbehaving activities based by ICAI.....
So, Please leave it.
Bcoz, You can earn more and more Money 💰 in future. So, leave it and go to your goal....

leave it now. its been 1 year from that incident. i suggest you to earn your salary in some other way, go to his client and convince him to give work to you instead of him. so by this way you can take revenge.... ;)

@ Raja - so what do you think his principal CA behaved in very right manner? sorry for that but i did not find any other way to teach that person a lesson. if you have a way (other than forgetting that money) kindly share.
