Due to the default of a Company, its Statutory Auditor doesn't receive letter confirming his appointment at the Company's AGM (the resolution has been adopted). Thus, the Statutory Auditor is unable to file e-form 23B within due date.
Will the Statutory Auditor be liable in this case?
On rec the appointment letter kindly meet the jurisdictional ROC officials and state the matter and in my view they may ask u to provide for a condonation letter with the reason mentioning the delay.
