Dear All,
As the paid up capital of the company at present is below rs 5 cr. therefore we have not taken the CG approval for the appointment of Chairmanand on the expeiry of hios term we have appointed him again and the company has decided to give him designation as Executive chairman. Now while filling annual return for this year what we should take his designation in it as Director/ chairmen . Kindly clarify doubt.

Select "C" only if he is chairman cum managing director.
Otherwise Select "D" and treat him as director for the purpose of annual return.
In this case we select "D" as he is only using the designation of Chairman but as per law he is only director.
