My client is senior citizen. this year only salary and short term and long term gain income (stt paid) but he has b/f लॉस of rs 119 of ay 20-21( INTEADAY LOSS). BUT in current year no any kind of business income. Although His current year tax liability is around rs 100000 and tds deducted rs. 33771. He is choosing ITR-3, will advance tax provision will applicable to him.

Should I choose itr 2 or file the itr 3 anyway

Quick Summary
This discussion explores the advance tax liability for a senior citizen who has brought forward business losses but currently only has salary and capital gains income. The core question is whether advance tax provisions apply and if ITR-2 is a more suitable filing option than ITR-3 when there's no current business income, to potentially avoid interest and penalties.

As there is no PGBP declaration, file ITR 2.

No interest penalty if advance tax not paid, by Sr. Ctz. without business income.
