What is this 21 Days Notice📃
AGM of a company may be called by giving not less than clear 21days notice either in writing✍ or through electronic mode💻
👉Postal Rule📮
✓Notice of a meeting is sent by post, the 'postal rule' must also be taken into account.
✓The Act provides that all postal mail sent out by a company is only deemed to be received by its recipients 48 hours after the moment it is posted.
✓However, the Act specifically requires that, in calculating such a 48 hour period, days that are non-business days (i.e. weekends and bank holidays) should not be counted.
👉Now📟
21 days notice + 2 days for posting + 2 days(the date of notice and the AGM is to be excluded) = 25Days ✌
From this you can see that 21 days is at least 25 days and could be as much as 27 days.🎙
Shorter Notice📣
Section 101(1) a General meeting may be called after giving a shorter notice if consent is given in writing or by electronic mode by not less than 95% of the members entitled to vote at Meeting.
