Sir, I have started a firm which is in construction field. And i have taken a contract and also completed it. But what should be the tax amount to be charged. my firm is based in Andhra Pradesh and i have executed the work in West Bengal. I have my CST and VAT number oF AP as my firm is based there. Now when i am submitting the bill to the firm in West Bengal what tax should i charge? WCT or Service Tax? And what is the amount of tax to be charged along with Cess?

There are two companies 'A' & 'B' in India. Both form a JV company 'C' (JV Company 1) on 50:50 basis. Both companies (A&B) are listed on stock exchanges and are Public Companies. 'A' and 'C' form another JV Company 'D' (JV Company 2) with equity particpation of 51% or more upto 76% by 'C' Company and balance equity shareholding to be held by 'A'. Company 'D' produces a product. Product Market price is Rs. X and cost price is Rs. X/3. Now we are plannning to Transfer materail from Company D to Company C at a price of (Cost+5% or X/3 * 1.05) on long term basis say for 25 to 30 years. Is this price mechanism possible/sustainable in the long term, keeping into consideration the present and imminent laws (DTC 2012 included). Facts: Company A, B, C, D are all in India and C, D are in same state but A and B are in different states.

A1. is a firm consisting of three partners SN, KN & US B2 is a Pvt. Ltd. Company in which SN.KN & US are directors and their shareholding in B2 is 60%, Rest of the directors are relatives of SN, KN & US and also balance shareholders are also relatives of SN,KN & US Accordingly A1. and B2 are interconnected undertaking and as per excise are related person A1. is selling material to B2 which is used by B2 for captive consumption and the selling price of A1 is cost of production + 7% and as per valuation rules “If goods are supplied to related person for captive consumption, valuation will be on basis of cost of production plus 10%.” Now the question is : •What should be done to avoid the relation of interconnected undertakings between the two •If SN, KN and US resign from B2. & also reduce their shareholding to below 50% in that case whether A1. & B2 still will be interconnected undertaking or not.
