This is Revenue’s appeal for the A.Y 2009-10 against the order of the CIT (A)-2, Guntur, dated 31.10.2019.

2. At the outset, the Ld. AR submitted before us that the assessee wanted to avail the benefit of “vivad se vishwas” scheme and had accordingly filed forms I & II under the scheme and it has received Form-III from the Department determining the net amount payable by the assessee. It is submitted that the assessee has also paid the amount and in proof thereof, it filed a copy of the challan as Annexure-3 to the letter dated 10.06.2021 and form-V is awaited. It therefore, prayed that the Department’s appeal be dismissed accordingly. 

3. The Ld. DR conceded to the request of the Ld. AR.

4. After hearing both the parties, according to the request of the assessee and its Ld. AR, we hereby dismiss the appeal of the Revenue with liberty to the Revenue to approach the Tribunal within the stipulated time as provided under the Act, in order to reinstate the appeal, if the application with respect to Vivad se Vishwas scheme is rejected/not accepted.

5. In the result, appeal of Revenue is dismissed.
