A Vehicle Owner Need Not To Verify Genuineness Of Driving License

Quick Summary
The Supreme Court has ruled that a vehicle owner is not obligated to verify the authenticity of a driver's licence if they have already assessed and are satisfied with the driver's skills. The owner's responsibility lies in ensuring the driver is competent and possesses adequate driving skills, not in independently confirming the licence's genuineness with the licensing authority. This judgment aims to prevent insurance companies from arbitrarily repudiating claims solely on the basis of a driver's licence being found to be not genuine after employment.

Court :
Supreme Court of India

Brief :
This is a landmark judgement of the Apex Court in which it was held that the owner of the vehicle is expected to verify the driving skills and not run to the licensing authority to verify the genuineness of the driving license before appointing a driver. Therefore, once the owner is satisfied that the driver is competent to drive the vehicle, it is not expected from the owner thereafter to verify the genuineness of the driving license issued to the driver. This will resolve various cases ,since it is a tool in the hand of insurance companies that Driving License submitted by not genuine and insurance company generally repudiates the claim on that basis.
