Sub: Notice u/s 274 read with section 272 of Income Tax Act 1961 issued to Mr. Rakesh Kr.
Dear Sir,
This is in reference to your letter No.ITO/Ward34 (4)/2008-09 dated 16/12/08 in regarding above mentioned subject, by mistake the PAN quoted in the return of Assessment year 2007-08 is incorrect. The correct PAN is AFPPJ3193H. Photocopy of the PAN card is enclosed herewith for your perusal.
Kindly do the needful to make the necessary changes in the return.
But i visited in the ward & Inspector told me that penalty should be applicable on assessee. Now please tell me how much chances of penalty. In PAN no. only last digit is wrong. Please Help me
Dear Dinesh, don't worry. No point in talking to inspector. The best thing in my opinion is that u wait for the notice and then reply as suggested by CA Bansal above.
U have not done anything wrong deliberately so don't get upset. In addition u can explain in the letter to the ITO that it was not malafied intention on assessee' s part and the same was not done deliberately to cause any loss to the revenue. U can also explain him the extent of the error and request him that this is a genuine mistake and should not be interpreted as fraud in any manner. The assessee will never gain anything by quoting wrong PAN to the dept. A human being is bound to make mistake some where, no one is perfect.
In the end, u can write a prayer that the assessee will take utmost care that such mistakes will not happen future and request the officer to file the notice. In my opinion the penalty should not be imposed. If imposed, u can appeal.
Try e-filing in future, such errors are impossible to take place.
