In that case ITC cannot be availed as it is not a right way it will be treated as tax escaped
There would be no issue on Purchase and Sale. However one should not that he pays back all the GST collected are correctly provided in his books and same has been paid back to the Department
As an auditor you must try to confirm there is no issue of Dual accounting where in GST disclosed is maintained in books and other transaction is carried otherwise

The Availment of ITC should not arise since the procurment is without GST
