Which itr to file

Hi

My Daughter is a student and has some fixed edeposits in her name.

Her net income is below Taxable limit but as her Bank Deducted TDS hence need to file ITR for claiming Refund.

Apart from Bank Interest she has no other Income.

Please guide which ITR to use for filing.

ITR 1 and interest could be shown under the head other sources

from next year onwards

submitting form 15g to the bank . informing not to deduct TDS

if the income is lower than basic exception limit u need not to file any return

Dear Sir,

first of all please clarify that whether Daughter is Minor or Not.

1) If we considered she is not minor:-

please file ITR-1 Show the income under the Income from other source. and then also put the information in Tds section as per Form 26AS.

Also there is another option to file form 15G or H in the bank which specify that Income of Daughter is not more than exemption limit so do not deduct the TDS.

2) If We considered she is Minor:-

In this case ,Income of minor becomes income of that parent who has more income that means if fathers income is 700000 RS and Mothers Income is 550000 Rs in this case Gross Income of Father is More than Mother. Therefore, the income of Daughter Club in the hands of Father.

Except Income received by Minor by way of performing their skill this type of income cannot be clubbed and this is the income of Minor.

If any Mistake is Happen from My side by explaining the provision please clarify me.
