Whether to rectify return or file d return

Income Tax return was filed before due date u/s 139(1). However, the income corresponding to the TDS was missed out to be captured in income.

As a result, there was intimation from department to rectify the same. However, filing reply to it has been missed out.

Currently, only partial refund is received.

To claim full refund, what is the better option to file rectification request or file updated return.

I hope that your TDS amount credited after you filed your ITR. And also, you declared all your income including this income which was missed right.

Then you can file revised return. For FY22-23, filling due was over. You can file updated return for the particular FY.

In this update return you can't add or remove income or deduction. You can't carry forward too. Please consultant with your Tax accountant or Chartered accountant.

 Under Section 139(5) of the Income Tax Act a Revised Return can be filed till 31st December of relevant Assessment Year, even after receiving intimation U/s 143(1), discovers any omission or any wrong statement therein, he may furnish a revised return at any time before the 31st December of the relevant assessment year or before the completion of the assessment, whichever is earlier.   

Considering that due date for revised return has already lapsed , what to do? this income has not been reported in original return filed
( there was intimation from department to rectify the same.)

dept knows the return can't be revised (updated return also not possible).

So, You can rectify the issues through ITD portal.

What notice/intimation You received...???
Which section...???

Note : You can't get that refund through ITR U.
Return defective notice was received us 139-9
Well...

You can short out the issue through e-filing portal.
If it's u/s 139(9) then go to e-filing portal and submit response.

Better to consult nearest Professionals...
Sec 139(9) is a separate section, the querist had not mentioned that.
