Whether recipient of goods can generate e-way bill

Whether recipient of goods can generate e-way bill, under the option-Inward given in E-way bill generation Portal.

If recipient can generate E-way bill for the goods received by him, what are the consequences

1. if Supplier of Goods not filled returns for the 2 months. (Since Supplier of Goods not able to generate e-way bill, if he not filed return upto 2 months)
2. if Transporter of Goods (Transport Agency) not filled returns for the 2 months.

Yes. Recipient can generate E-Waybill.

A) Yes... E-way bill can be prepare Recipient of goods.

1. As per GST seller only can file his sale bills in GST as GSTR 1 return. Buyer can't take any action except following to the supplier...

2. No problem. You can show the details as rcm head.

But as per the FAQ's released by CBIC E-WAY BILL SYSTEM Blocking/Unblocking of E-way Bills Generation, Point No.11 & 12 CBIC given replies as below

11. Whether recipient can generate e-way bill on blocked supplier and vice versa? Ans: No, if supplier or recipient is blocked for e-way bill generation, then neither supplier nor recipient can generate e-way bill between them.

12. Can transporter generate e-way bill on blocked supplier or recipient? Ans: No, the transporter also cannot generate the e-way bills, if supplier or recipient is blocked due to non-filing of returns.

As per the above explanation, recipient of goods cannot generate E-way bill, if Supplier of goods e-way bill blocked for non filling of returns for continuous period of 2 months.
