If P and L are prepare Exclusive of GST and GST paid is not claim as expenses whether the Refund of GST is Taxable U/s 41 ??

Sir, As per sec 41 if you claim expenses of GST for calculation of PGBP then the Refund of GST is taxable.If I can't claim expenses of GST then also Can GST refund Taxable ??
