Where is such condition in ccr 2004

Dear Expertzs,

Our R.O is telling that , if you have availed INPUT SERVICES Cenvat Credit on the strength of Service Provider's Invoices, You have to verify/satisfy, whether the SP has deposited their liability of ST deposited or not ?

 as per my knowledge , the said condition not in CCR ruless 2004.

Please clarify, my version is correct or Dept's version is correct? if so, please provide the relavent notfn/rule?
